I would defo give it a go, the document produced by the NHS Employers should be being used and if not questions need to be asked why. How much money did they waste in producing it if its not being used please keep us updated

So I applied for a job, was interviewed and was informed last night I was successful. Great! On the form it asked about unspent convictions and I selected I had one. There were two options after that. Give details on the form or select to provide them separately. I selected separately and it then said a member of the recruitment team would be in touch. This has happened yet. It’s the NHS so there are going to be pre-employment checks however a DBS won’t be needed, as the role doesn’t require one. I’m not sure if they will ask for more information at this stage or not.

I’ve actually decided to fight this a little more because after reading the information Unlock have posted recently about working in healthcare and then linking to the 32 page pdf document that was produced this year. It seems the organisation have not followed what’s in it, they don’t seem to have considered all the information and for some reason have failed to respond to emails regarding seeking information in terms of a risk assessment. I think my next step is to put a formal complaint in about how they handled it and also ask for a SAR in relation to all data held in relation to my application and subsequent decision to withdraw the job offer.

I did try to ask some follow up questions but the woman has ignored my emails. My conviction is not spent for 1 year 9 months so didn’t think it was worth chasing for answers. You think it would be worth chasing after all this time?

Thanks you. Makes me more determined to carry on to make successful applications and try and find an employer that might give me the chance. In the meantime it gives me good practice.

It’s my pleasure. I did like that they encouraged me to reapply once it has become spent because I had given a good interview and they would have no issue on having me onboard then. However it will be interesting to see if that was just said out of wanting to get out of it for how. If I still haven’t secured a job in 1 year and 10 months time when it becomes spent I’d certainly apply again if the vacancy cropped up.

I've heard of another case a few weeks ago that fell at the "unspent" hurdle and that was for an overnight warehouse job. It's an absolute joke. I know unlock are trying to push movement on being unspent and I really hope they succeed, it's not fit for purpose. Thanks for sharing your journey, most of us here can relate to these frustrations.

I’ve spoken to Unlock a few times and they have advised there is no course to challenge it since they don’t have an appeals process and have said that the decision is final. I will see if they will put it in writing for me.

Bit of a weird explanation, it was just “because the nature of the offence and the complexity of our organisation”. I did say, how did you come to the decision and was a risk assessment carried out and she said she would speak to central HR. I thought the fact that the role has no relevance to my offence, that the PPU were happy & the fact none restrictions interfere with the role too would have went in my favour. One good point, they said once it had become spent, reapply, so that makes me wonder if they have some sort of strict policy that says if it’s unspent it’s an automatic no.

Nothing yet. They did agree that none of my restrictions would interfere with the job. She said it wouldn’t be her decision, so it’s a waiting game.

Further update: They have followed up with the disclosure. Just had a conference call.
