I hope somebody can help as I'm stressed :(

I was given full legal aid for a trial in Aug 2010 i was found guilty and sentenced to 6 years , my wife stood by me fully..

In July 2012 a letter arrived at our home addressed to me from a company called rossendales ltd asking for £8000 towards my legal fees they were recovering a dept we had never been notified about..

My wife took advice from CAB to write back stating i did not live at this address we heard nothing back...

I was released from prison in august 2013 so near 18 months ago and 30 months since my wife wrote back to rossendales..

Then to of the blue yesterday i get a letter stating i need to pay ...

Help please as i don't have 8k i am working on min hours and min wages my wife is unable to work due to ill health we just can't afford anything.. we have sold anything of value just to live..

Well looks like this just won't go away...

A few weeks ago I got another letter from Rossendales, no longer demanding thousands but £500, I figured here we go again so I sent a nice little letter back to the LAA asking them if they could sort it out like they said they had before... Well today I get a snotty response saying I'm liable for the costs Rossendales incured basically chasing a debt I didn't owe because the LAA won't admit they made a mistake.

Needless to say huge complaint going out in post Monday morning!

Some days you think you've moved on.. They something comes and drags you back down.

Hi, are you asking me?

I plead not guilty to Section 18. On the day of the trial I plead guilty to Section 20 (As I had offered previously during pre-trial). The judge accepted my plea and reserved my case for his special treatment at my sentencing. The rest is history.

I got 16 months for it.

My master-stroke is that their initial claim is based on me owning a 50% share in the house. Due to my impending divorce, I have had to settle for 30% which swing the odds enough in my favour to tell Rossendales to go forth and multiply. I'm making them work whilst I get the proof though.

It will be worth getting in touch with some of the debt charities for advice and assistance - Stepchange for instance. They have some great advice regarding this sort of thing and it's where I got the details of how to complain to the FSA due to their persistent phone calls chasing me for Legal Aid which was wrongly assessed when I was first arrested.

Good luck and don't let them grind you down.

As link said, that doesn't sound good. Hopefully you can take a little heart from my dealings with them.

Rossendales are after ~£2,000 from me and despite three requests so far, they haven't provided me with the full details of how they arrived at this sum. They've said that it's the "equity in my house" so I asked them for calculations of how they calculated this equity, what valuation they put on the house etc. and when I received a phone call from them a couple of weeks ago, I was ready to tell them that any further contact from them would result in a complaint direct to the FSA. They did confirm that they hadn't received my last letter so I couldn't really fault them. I did manage to get an email address to send my correspondence to so I sent my letter with a request that they acknowledge receipt. I received no receipt but a phone call last week to them confirmed that they had received it and they had sent an acknowledgement. I hadn't received it (via email) so they sent a replacement and I received that through the post a couple of days later and they have said they will respond in the next 14 days. They have 5 days left....

Only they have the power to clear your debt so don't expect anything from rossendales other than threats and fear mongering!

On the same subject I sent letters to both the legal aid agency and rossendales, somehow the ones to rossendales got sent back to me claiming unpaid postage despite it being correct, so I'm now sending it back by recorded delivery along with the letter from the LAA proving my debt is now resolved!

Ok just off the phone again from rossendales they are not giving in, i owe £8000 and they give 6 months to pay lol don't know where they believe I'm getting £1350 a month from ...

They are the most arrogant people i have ever spoke with they have now threatened that unless i pay they will put a charge on my house..

Anyone help ?

HI E72, I have good news to report...

I have had no further correspondence from rossendales but I agree they were typical "ballifs" on the phone and had no interests in the facts at hand etc.

I sent proof of my finances to the legal aid agency, bank statements, mortgage statements, credit card bills etc. A few days ago I had a reply saying that my debt had been reduced to nil, and to report any contact from rossendales directly to the legal aid agency... This was not the grovelling apology I was expecting and they haven't accepted any responsibility for the mistake but at least it's over I think!

I would recommend you contact the LAA directly as rosendales were no use to talk to, if they keep hassling you seek help from the CAB, hopefully you will have better luck!

Quick update i have had contact with the so called rossendales they are very rude and still demanding the money..

I have explained that the order should have been mentioned in court after end of proceedings they replied thats the judges fault not ours...

I then explained that i should have received a bill no later than 21 days after proceeding so i had time to appeal once again not their fault its down to the Legal Services Commission...

They have an answer to everything and just demand the cash i have told them i would not pay them anyway as they have told me their charges have been added due to admin letters etc ..

as i think the next step is to write to the LSC...

I'm in a similar situation with Rossendales. I was granted full legal aid (eventually), had my case dealt with in August and a few weeks ago had a letter asking for a couple of thousand due to owning two houses!! I don't own two houses and they claim that I have an extortionate amount of equity in the house. To cut a long story short, I've had correspondence with them including complaining about how they were harassing me for money before my Legal Aid was granted. I got a sort of apology from them but they still want the money. I'm disputing it as the ex and I have agreed a 70/30 split in her favour but they want legal documentation to back that up. The fight goes on...

I don't know about E72's situation but I'm just waiting for the LAA to reply to me...

In brief I sent a huge stack of evidence to the LLA explaining my finances (or lack of them I should say), and a copy of it along with a 1000 word complaint to Rossendales about there handling of the situation... I'll let you know more once I hear anything!

That's a useful link east72, although it worries me what you've been told by your solicitor. I may be misunderstanding this, but she is a criminal solicitor who was acting for you at the time that you were given that order by the court (which directly relates to the service that she's provided you with), so although you can make a complaint about the bailiff, I'd also thought you might want to make a complaint about your original solicitor if this is the first you've heard of it.

A CCO is made in a Crown Court or the High Court. However you only have 21 days after the date of the close of proceedings not necessarily the conviction date to appeal against the order by writing to the judge. You will need professional advice for this.

If you first become aware of a CCO being made is a bailiff's letter then check the document to see if any of the following applies.

1. It does not comply with Regulation 6 of the CDS(CO)R 2009 because no means test was made before making the order.

2. It does not comply with Regulation 22 of the CDS(CO)R 2009 which sets out the content of an order.

3. The assessment as to your CURRENT means and circumstances is wrong or recently changed or is based on wrong information.

4. You received the Order MORE than 21 days after the end of the proceedings which denies your statutory right of appeal.

5. The letter is from a private company and not from the assessing authority which means the inferred liability may not be genuine.

Write to the Legal Services commission and make a FORMAL COMPLAINT and ALWAYS enclose a copy of the original document.

Using this sample, delete the grounds listed that DO NOT apply to you.

I guess I meant both. I would have hoped that your solicitors would have been able to tell you on what basis they provided their initial representation (which I assume is where this cost has come from?). From what I've learnt since first hearing about this, it's quite common for individuals to have legal aid but with a contribution from them if they're found guilty (because of their earnings/property etc).

For me, the issue is whether, when people get legal aid, if it's made clear the basis of their contribution.

That's why I'd hope anybody who finds themselves in this kind of situation, would be able to go back to their solicitors to get their advice?
