Changing passport will not resolve any such issue. Any 'marker' that is placed on a passport contains no information about criminal records, and can only be seen by UK border officials - in reality, it's not actually a marker whatsoever, it is the fact that any registered SOs passport will be on the "HM Passport Office Watch List". This is supposed to help combat things such as people changing their names without notifying etc.

By your explanation of events, it sounds like some information was previously shared with Spain about your criminal record that they have retained. They may have powers to do this for the 'prevention and detection of crime', as per the similar exemption available in UK DPA2018 legislation. The honest answer is that I have no clue how you'd go about resolving it - but this is almost certainly to do with the Spanish authorities, and not the UK authorities, as if your passport is working on UK eGates, your passport is no longer on the HMPO 'watch list'.

I had some fantastic help and guidance from the forums and Unlock relating to having my convictions removed from my BASIC DBS check, due to the fact that they were officially classed as spent. Thank you everyone involved. 

I still have another issue, and I have attempted to contact Visa firms for assistance, but I do not seem to gain any ground.

My issue is that I am still being stopped on entry and exit in Spain, travelling to and from the UK. I am asked about the length of stay, address, and phone number. They take a photo the 'screen' information, my passport and boarding pass, often asking for my return pass also.

When I was successful in having my conviction noted as spent, I also managed to contact UK Border Force, and I am now no longer stopped on return into the UK I pass through the automated barriers like any other person.

Can anyone please point me in the right direction as to how I can have whatever notice I have on me removed in the EU? I do not mind if this is an expert, a legal representative or a consulate, etc., I just need some hope that I can remove the stress and anxiety I feel every time I travel to see family and friends.

My logic is that if I am no longer of interest to UK Borders, I should not have issues with the Spanish border?

I haven't had any checks by Border Police in Spain. There shouldn't be any notices on you in the EU unless they are using previously held information about you.

Assuming this is tied to your passport have you tried replacing your passport and see if the checks go away? I would say that is the most obvious thing to try first if you haven't already done so.


I agree there shouldnt be any but there are. Every entry and exit. I have not changed my passport no, perhaps an option I suppose. Thank you
