Hi

I am lucky enough to own my own flat and also a share in the freehold. This means the other owners and myself are answerable only to ourselves.
Sounds great but it lacked direction and therefore building maintenance was not been undertaken, so I and an other owner took on roles as directors.
This has been great in get things done but I've made the mistake of asking about "Directors Indemnity" Insurance, or in simpler terms what insurance is in place to stop anyone suing the directors for any of various reasons.

Now to the reason for this topic.

The agent we use for day to day stuff has organised this and sent me the policy; and of course there is a clause in it that you have to declare any offences not related to motoring.

I'm going to look into this as mine is spent but do I have to declare?

Interested to hear from others in this situation as obviously I do not wish to declare.

Society suggests I must let go of all my expectations but I disagree, as whilst I have a voice, I have hope.

Learn from yesterday, live for today, hope is for tomorrow else what is left if you remove a mans hope.

If your conviction is spent then you don't have to disclose it for any insurance policy taken out in the UK, whether it's personal or commercial. Like the adverts used to say: "Just say no".

As AB2014 rightly points out, you are entitled to withhold details of any spent conviction for any insurance policies. The question essentially should be "If we conduct a Basic DBS check on you, what will we see?"

Hi

Thank you for confirming my initial thoughts.
I may see if I can find an insurance firm that does not ask; however I do not want to ask questions why unless its a better deal. LOL

No need to find a firm that doesn't ask. You don't need to legally disclose even if they do ask. Just say no.

Remember, there is a big difference between 'moral' honesty and 'legal' honesty. The law entitles you to be treated as if you did not have the conviction when applying for insurance, as it is spent. You are entitled to withhold information about a spent conviction or 'any circumstances ancillary thereto'.

Simply search for the cheapest price, not the company asking the clearest question - most of them have zero idea about how the ROA works anyway!
