Hi Gossi

Many employers have some roles in their organisation which are covered by the Rehabilitation of Offenders Act and some which are exempt. They will often use the same application form for both which can cause a huge amount of confusion as you really don't know what you should be disclosing and what you shouldn't.

I would expect a retail role of this nature to be covered by the Act and you would only need to disclose 'unspent' convictions.

Welcome to the Forum.

Any employer can apply for a basic criminal record check for any job.

Standard Disclosure and Barring Service Checks are not particularly common and are generally used for people working in security and roles which are covered by a regulated body - i.e. finance jobs.

The highest level checks, enhanced are generally applicable for jobs that involve working with children and vulnerable adults. Both standard and enhanced checks will disclose both spent and unspent convictions.

Now that your conviction is spent, it is important that you know which level of check an employer will undertake. Before you give your agreement to any check, make sure that the job you are applying for is eligible for the level of check that's being done.

There isn't a list of employers that do basic checks as it would probably run into thousands of pages. Any company is entitled to do a basic check and many do. A lot of them will make this clear on the application form, some will wait until the interview stage.

There has been quite a lot of publicity about Morrisons but not all do basic checks. Sainsbury's for example only do basic criminal record checks on it's on-line drivers but don't do them on any other member of staff.

By the way Morrisons news article is incorrect they do NOT run dbs checks on staff only the basic standard or basic Scotland back ground check as it is for all supermarkets I believe.

A list would be quite hard to do or manage but yeah would solve many issues if people knew which employer runs which type of check this way we would not waste hours or time getting hopes up etc.

But the general jist of it is if its a job role working directly with children or elderly then a dbs check is done which shows ALL.

Doctors
Nurses
Carers
Dentist
Teachers
Financial services -ie banks or where large amounts of money, responsibility etc.

Offices, Warehouses, retail, shops, supermarkets even charities on the high street they should only be allowed to run basic Scotland checks. Also to note the "google effect" make sure hopefully your past is not advertised on newspapers or internet articles, many companies do a google check with your name to see any dirt to misuse against you.

In regards to your question above not sure actually, sounds like they may ask for a basic scotland check or they may ask for a dbs check- again if you think the job position is not any on the small list I said above you can contact dbs and dispute it or not fill that form in tell your boss to be you need to check with dbs offices if its ok, if they find that funny perhaps suggest you had an issue with dbs last time.... remember the dbs check comes back to your home address only.

I know people that gone for oxfam and Aid/charity shops and nadda done not even the basic scotland check, guess its seen as retail shop roles.

Guess like most sometimes just gotta go for it and if anything remotely "dbs" pops up one can leg it, just be aware if you sign that dbs form and vanish they company can ask for for the money for the check !

Hello all,

New to the forum here and first post.

I have recently applied for and received my basic disclosure (only took 2 days!) to double check that my convictions are indeed spent, the positive news was that they were and the basic disclosure was clear.

My question....are the basic disclosures commonly used by employers as as check and is there a list of what employers actually use these instead of the standard ones. Understand that it will really depend on the position and authority held but thought do ask to see if there was any real clarity.
