I've been doing some research with regards to the FCA and employment of people within the financial sector

We have a fit and proper test which is a benchmark weuse to assess whether an individual is suitable to perform a controlled function. Examples of controlled functions include being a director of a regulated firm, overseeing the firms systems and controls and being responsible for compliance with our rules.

 When considering an individual's fitness and propriety we look at honesty including openness with self-disclosures, integrity, reputation and competence and capability and financial soundness. But we don't have any specific rules around the firms we regulate employing individuals with convictions.

I've looked at the FCA policy and the following is states (

FIT 2.1 Honesty, integrity and reputation)

A relevant authorised person determining the honesty, integrity and reputation of staff being assessed under FIT, should consider all relevant matters, including those set out inFIT 2.1.3G, which may have arisen either in the United Kingdom or elsewhere. Firmsshould inform themselves of relevant matters, including checking for convictions for criminal offences (where possible) and contacting previous employers who have employed that candidate or person. If any staff being assessed under FIT has a conviction for a criminal offence, the firm should consider the seriousness of and circumstances surrounding the offence, the explanation offered by that person, the relevance of the offence to the proposed role, the passage of time since the offence was committed and evidence of the individual’s rehabilitation.

NHS in mental health care, 10 years after 2 minor offences on the same day. "Its not our policy to employ" the man in charge kept repeating (management training teaches them to repeat the same sentence till you give up). Their loss, applied to do Youth work at Social Services and they have always been very understanding.

All Schools - I have spent the last 8 months training to be a teaching assistant working with children with Autism. In 2009 I served 3 months for a theft related to my debt problems at the time.
Every job I've applied for so far has all been the same - not while you have unspent conviction - clearly my time was not related to anything that would make me a danger to children, and nor have I been marked as not being able to work with them either when I get my DBS check.
One headmistress wanted to give me the role I applied for saying I was perfect and everything she wanted in a support teacher role, but HR said no, despite her arguing my case for 2 hours.

I never disclose, ever. It's idiotic to do so.

In my eyes asking for a CBR will result in no job offer so any job who asks for one are discriminating from the start.


I think you have the right idea very few employers especially those with dedicated HR teams care about your past your a crim in their eyes and there are 30 people waiting in line for the same job you applied for so no loss to them
if they require a dbs i may risk telling them or just turn down the job and leave there are no incentives for telling the truth yes the the system as it is now encourages you be dishonest which doesnt help our image as a whole.

Well obviously they are going to discriminate against you if your conviction isn't spent. I don't get it.
